Terms of Use

The Leading Medicine Guide is operated by Deutscher Verlag für Gesundheitsinformation GmbH (Legal Notice), hereinafter referred to as “DVFGI.” The Leading Medicine Guide is made available to its visitors based on these Terms of Use. Please read them carefully.

The Leading Medicine Guide is intended solely for general informational purposes. It is not intended to replace a doctor in any way and does not provide individualized medical advice.

To use the Leading Medicine Guide, you must agree to these Terms of Use.

1. Scope

1.1 These General Terms of Use apply to all offerings of the Leading Medicine Guide, accessible at https://www.leading-medicine-guide.de (the “Websites”) and its other online presences, as well as to all extensions and modifications thereof. The users’ general terms and conditions do not apply.

1.2 To the extent that services are offered through the Websites (e.g., informational texts, contact referral), additional special terms of use may apply. The user will be notified of this separately. Special terms of use take precedence over these general terms of use to the extent that they contain differing provisions.

1.3 If services are provided by cooperation partners or third parties (e.g., doctors, clinics), the general terms and conditions of the partners or third parties may also apply. If third-party services are arranged for the user through Leading Medicine Guide, contractual relationships are established solely between the user and the third party.

2. User Base and Availability

2.1 The offerings and services of Leading Medicine Guide are freely accessible to everyone. Use is free of charge unless it is indicated that individual services are subject to a fee. The DVFGI reserves the right to provide certain services and offerings only to users of legal age.

2.2 The DVFGI is entitled to modify or expand its offerings and services at any time, and to suspend them either temporarily or permanently.

2.3 The DVFGI endeavors, within the limits of its technical and organizational capabilities, to provide access to its websites 24 hours a day. Due to maintenance work, Internet-related disruptions, or force majeure, access to the websites or to specific offers and services may be limited or completely suspended. Users have no right to expect that the websites or specific offers and services will be accessible.

3. User Obligations

3.1 The user is obligated to comply with these Terms of Use and the law, and not to use the offerings and services provided through the Leading Medicine Guide for unlawful purposes.

3.2 Furthermore, the offerings and services provided through the Leading Medicine Guide may not be used for commercial purposes. The same applies to any actions by the user that are likely to impair the offerings and services provided through the Leading Medicine Guide or render them inoperable.

3.3 The user is obligated to indemnify the DVFGI for all damages resulting from a breach of the aforementioned obligations and/or a related infringement of the rights of third parties. This also includes indirect damages and financial losses. The user shall indemnify the DVFGI against all claims by third parties in this regard, unless the user is not responsible for such a breach.

4. Responsibility for the Content of Leading Medicine Guide

4.1 The DVFGI endeavors to ensure the accuracy, completeness, and timeliness of the content, information (e.g., addresses, areas of expertise, services, etc.), and services published on the websites; however, it assumes no liability in this regard. A large amount of the content, information, and services on the websites is provided by third parties (in particular, physicians and clinics). This applies in particular to the content provided by the listed physicians. The inclusion of this content does not constitute a recommendation or guarantee by the DVFGI. The DVFGI is not responsible for this content. These third parties are not agents of the DVFGI.

4.2 If the user accesses external websites via links on the website, responsibility also lies exclusively with the providers of those sites. The DVFGI does not endorse the content of these sites. Any liability or warranty on the part of the DVFGI for the content of the linked sites is excluded. At the time the links were created, the DVFGI was not aware of any illegal content on the linked sites. The DVFGI has no influence over current or future changes to the linked sites.

4.3 The DVFGI also does not endorse the content of banners or other advertising spaces. Any liability or warranty regarding this content is excluded.

4.4 To the extent that Leading Medicine Guide provides users with the opportunity to contact physicians, clinics, or other third parties, this does not constitute a recommendation or guarantee by the DVFGI. DVFGI is not responsible for statements made by affiliated doctors, clinics, and third parties in the context of subsequent treatment or diagnosis.

4.5 Content on Leading Medicine Guide is provided for informational purposes only and is not a substitute for a medical consultation. If you have any health concerns, please consult a doctor.

5. Liability

The DVFGI is always liable for intentional acts, gross negligence, personal injury caused by its fault, under the Product Liability Act, and for guarantees expressly granted by the DVFGI. The DVFGI is liable for slight negligence only in the event of a breach of a material contractual obligation, in which case the amount of such claims for damages is limited to the foreseeable damages. The limitations or exclusions of liability also apply to the personal liability of the DVFGI’s employees, staff, representatives, officers, and agents.

6. Data Protection

The DVFGI complies with statutory data protection regulations. User data is treated confidentially. Data will only be disclosed to third parties to the extent permitted by data protection regulations or with the user’s consent. The Leading Medicine Guide’s Privacy Policy applies.

7. Copyright

All content, information, images, databases, and services published on the websites are protected by copyright. Use is permitted solely for personal, private purposes. Any further use, in particular commercial reproduction, distribution, or publication for commercial purposes, is prohibited. The same applies to the integration and/or display of the websites via an embedded hyperlink (framing). Violations will be prosecuted by the DVFGI under civil and/or criminal law.

8. Miscellaneous Provisions

These General Terms of Use may be amended by the DVFGI at any time. In business dealings with entrepreneurs, legal entities under public law, or special funds under public law, the place of performance and exclusive venue shall be Heidelberg. Mandatory statutory venues shall remain unaffected. The law of the Federal Republic of Germany applies, with the exception of its conflict-of-laws provisions. Should any provision of these General Terms of Use be or become invalid in whole or in part, the remaining provisions shall remain unaffected. The invalid provision shall be deemed replaced by a valid provision that most closely approximates the economic purpose of the invalid provision. The same applies to any gaps in these terms.
